Welcome to KyudaGPT. These Terms of Service ("Terms") govern your access to and use of the KyudaGPT Chrome extension and the kyuda.io website (collectively, the "Service"), operated by Alpine Code ("we", "us", or "our"). By installing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using KyudaGPT, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

2. Description of Service

KyudaGPT is a Chrome browser extension that provides AI-powered features including, but not limited to, chat, content summarization, translation, writing assistance, image generation, and smart search. The Service is provided "as is" and may be updated, modified, or discontinued at any time.

3. Acceptable Use

When using the Service, you agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose
  • Generate content that is defamatory, obscene, threatening, or violates the rights of others
  • Attempt to reverse-engineer, decompile, or disassemble the extension or its underlying systems
  • Circumvent, disable, or interfere with any security or access-control features of the Service
  • Use automated scripts or bots to access or interact with the Service
  • Misrepresent AI-generated content as human-created work where disclosure is required by law or regulation
  • Transmit viruses, malware, or any other harmful code through the Service

We reserve the right to suspend or terminate your access to the Service if you violate these terms.

4. Intellectual Property

4.1 Our Property

The Service, including its design, code, branding, logos, and documentation, is owned by Alpine Code and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

4.2 Your Content

You retain ownership of any content you submit through the Service (e.g., prompts, text). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service's functionality. We do not claim ownership over your inputs or the AI-generated outputs you receive.

5. AI-Generated Content

The Service uses third-party AI models to generate responses, translations, summaries, images, and other content. You acknowledge and agree that:

  • AI-generated content may not always be accurate, complete, or up to date
  • You are solely responsible for reviewing and verifying AI outputs before relying on them
  • AI-generated content should not be used as a substitute for professional advice (legal, medical, financial, etc.)
  • We do not guarantee specific results or outcomes from the use of AI features

6. Third-Party Services

The Service relies on third-party AI model providers and other external services to deliver its features. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of the Service may be subject to additional terms imposed by these providers.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Alpine Code and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits, or business interruption, regardless of the theory of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Alpine Code and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time by uninstalling the extension. Upon termination, the provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, and limitation of liability) will remain in effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Alpine Code operates, without regard to its conflict of law provisions.
